Trial Strategy
To win at trial you must unanimously persuade 12 individual jurors that your client’s version is the TRUTH. To do this, you need to present your case in a way that neutral finders of fact become your active jurors—those special jurors who fight hard during deliberations to make sure that the side they think is right wins.
This conversion from neutral to active jurors does not just automatically happen. Instead, it takes place when you are able, through the use of carefully crafted persuasion tools, to trigger a core value in one or more jurors. Our trial strategists work with you to increase the chances of this happening in your client’s favor. We do this primarily using two strategy services: Mental Mining® and Feedback Forum, through which we find ways to uncover the themes and theories of your case; simplify complex legal and technical details, and create arguments that jurors understand and relate to. Our methods work to increase the chances of this happening by:
- Developing a trial strategy that conveys your position, using powerful themes associated with one or more core values;
- Simplifying your case in a way that makes your case easier to understand and, as a result, more persuasive; and
- Presenting the case efficiently and in a way that respects the jurors’ time and intelligence.
