Mental Mining

When a juror is learning new information, two things are happening simultaneously: the conscious mind memorizes vital information, such as names, dates, places, and other details; and the subconscious finds ways to understand the new information by arranging the facts into a story while comparing this newly created narrative to information that is already familiar.

Through our Mental Mining® methodology, The Focal Point team explores subconscious associations, listens critically both to what is being said directly and what is being inferred, asks probing questions, and records images, analogies, and other descriptions as they consciously search for relevant metaphors, analogies, and themes that help explain the case.

By the end of a Mental Mining session, we will have developed a story that can be the basis for your case, plus a strategy and a list of potential visual tools that will communicate the facts and themes clearly and convincingly.

  • Challenge youwhen your story needs clarification or constructive narrowing
